The expectation for companies to conduct HREDD is increasingly becoming mandated by legislators across the globe. Examples include the German Supply Chain Due Diligence Act, which entered into force on 1 January 2023 as well as the EU’s Corporate Sustainability Due Diligence Directive which was adopted by the European Parliament on 1 June 2023. Stakeholder engagement and the involvement of rightsholders will be critical for in-scope companies to successfully implement human rights and environmental due diligence processes and ensure compliance with these obligations.
Engaging stakeholders and involving rightsholders in a meaningful way is a central characteristic of human rights and environmental due diligence and enshrined in the UN Guiding Principles for Business and Human Rights and other key frameworks, such as the OECD Due Diligence Guidance for Responsible Business Conduct. In fact, the perspective of stakeholders matters in every step of a companies’ due diligence journey: when identifying and assessing negative human rights risks and impacts, tracking and reporting on risks and impacts, designing effective grievance mechanisms, and providing targeted remediation.
